Terms & Conditions
The client hereby expressly waives the application of its general terms and conditions, even if issued after the present terms and conditions of sale. Any deviation from these conditions shall only be valid if explicitly agreed upon in writing in advance.
All invoices issued by Geeks Evolution are payable immediately after issuance of invoice, unless otherwise stated on the invoice or the order confirmation. A credit facility of up to 7 days can be requested on order confirmation only against a valid LPO issued for Geeks Evolution FZE LLC with prior written approval on the credit request. In the event of late payment, Geeks Evolution reserves the right to charge a fixed interest fee of 10% on the outstanding amount. Furthermore, Geeks Evolution may suspend service delivery without prior notice due to delayed payments.
If payment remains unsettled 60 days past the due date, Geeks Evolution reserves the right to engage a debt recovery agency. All associated legal and recovery costs will be the responsibility of the client.
Certain countries impose withholding taxes on invoices as per their domestic regulations. Such tax withholdings are solely the client’s responsibility and must be paid directly to the respective tax authorities. Geeks Evolution shall not be held liable for any tax obligations resulting from foreign legislation. The full invoiced amount remains payable to Geeks Evolution without any deductions.
Geeks Evolution commits to providing high-quality services within agreed timelines. However, these commitments do not constitute an obligation of result. Geeks Evolution shall not be held liable or required to act as a third party in any claims initiated by an end user against the client.
To be admissible, any complaints must be sent via recorded delivery to Geeks Evolution’s registered office within 8 days of service delivery or product receipt.
All contractual relations shall be governed exclusively by the laws of the United Arab Emirates.
All equipment rentals arranged by the client will be delivered via courier on behalf of Geeks Evolution. The rented equipment remains the exclusive property of Geeks Evolution, and the client holds no ownership rights except as granted under this Rental Agreement.
Geeks Evolution will make all reasonable efforts to deliver the equipment by the scheduled date and time. However, it shall not be held liable for delays due to unforeseen circumstances. Upon delivery, all risk of loss, theft, damage, or destruction of the equipment transfers to the client. The client bears full responsibility for the equipment throughout the rental period and until it is returned to Geeks Evolution.
The client must immediately notify Geeks Evolution in writing of any changes to the delivery address or contact details.
The client may return the rented equipment in person or by a courier service approved by Geeks Evolution. All returns must be completed by 5:00 PM on the last working day of the rental period. If the end date falls on a weekend or public holiday, returns must occur on the next business day. If returned via courier, next-day delivery is required, and proof of collection before the deadline must be provided.
Failure to return equipment on time will result in daily pro-rated charges, and Geeks Evolution reserves the right to extend the rental term or charge the full retail value for recovery of its assets.
Rented equipment is not insured. The client must ensure the equipment for its full replacement value throughout the rental and extension period(s). The client accepts full liability for the safe return of all equipment.
If the client cancels an order after confirmation, a cancellation fee of 50% of the rental value will apply. If cancellation occurs within two working days of the scheduled delivery, the client will be charged 100% of the rental value.
If software or an operating system is included with the rental, the client confirms that only backup copies will be made and that such copies will be destroyed after the rental period. For iPad rentals, the client agrees to comply with Apple’s user terms and conditions, available at www.apple.com
If Geeks Evolution is requested to install additional software on the rented equipment, the client warrants possession of a valid license for such software. The client also agrees to indemnify and hold harmless Geeks Evolution from any liability or loss resulting from the installation or use of the software.
